Terms of service

1. These terms

Birdied is a golf course tracking service run by Scott M Limited, the company named above. By creating an account or using Birdied (the "Service") you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Service. Nothing in these terms takes away rights the law gives you as a consumer.

2. Who can use Birdied

You must be at least 13 years old to hold an account. By creating one you confirm that you are. Keep one account, give us a real email address, and keep your password to yourself: you are responsible for what happens under your account until you tell us it has been compromised.

Signed-in members see your display name beside what you post. So does anyone you share your Passport or year card with, including in the preview a shared link shows, and anyone you share a list with if you choose to show your name on it. A review on a course page is public without your name. It may not be an email address, and some names are reserved because they read as Birdied itself or as someone who speaks for it: birdied, admin, administrator, founder, moderator, support, staff, and any name that carries the word Birdied. We refuse those at sign-up and when you change your name, and we may ask you to change a name that misleads other members about who you are.

3. The Service

Birdied lets you log the rounds you have played, keep a record of the courses and countries you have visited, rate and review courses, keep a wishlist of the courses still ahead, and share your activity with friends you choose. Course facts come from public sources, including OpenStreetMap, and from members. We check what we can, but a course's own website is the authority on its opening hours, fees and access. We may add, change or withdraw features as Birdied grows.

4. Your content

You own what you add to Birdied: your rounds, reviews, ratings, lists, comments and display name. So that we can run the Service you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display and distribute that content:

The licence ends when you delete the content or your account, except that a search engine or other service may keep a copy it already took, and an aggregate already derived from your content, such as an average rating, may persist. A list you shared with a friend you made its editor is not deleted with your account. It passes to that friend, with its name and its courses, or to the first editor you added if there are several. You must have the right to add what you add: do not post someone else's words or photos, or another person's personal information, without their permission. We may use what you add to improve Birdied, for example to check course facts members report.

6. Reporting, blocking and removal

Birdied is a place where members share content with each other, and we take our duty to keep it safe seriously. Every review, comment, shared list and member profile carries a Report control. A report goes to our administrators with the reason you give, if any (spam, harassment, hate, sexual content, or something else); we look at it and take the content down if it breaks these terms, and the member is not told who reported it. You can block a member from their profile or from something they wrote: you will then not see their reviews or comments, they cannot comment on your activity or become your friend, and any friendship between you ends. You can see and undo your blocks from the Profile tab.

Our administrators may remove a review, comment or list, and may suspend or delete an account, where content or conduct breaks these terms or the law. We take down content that is illegal as soon as we know of it, and where the law requires it we report it to the police or the National Crime Agency. Every removal, suspension and deletion is recorded in an audit log. Suspension ends your sessions, refuses sign-in and hides your reviews, comments, lists and shared rounds until it is lifted; deletion removes the account and what it posted.

If you think we removed something wrongly, suspended you in error, or did not act on a report you made, write to us from the contact page and we will look again. We aim to answer every complaint.

7. Suspension, termination and deletion

We may suspend or delete your account if you break these terms, if the law requires it, or if we close the Service. Where we can, we will tell you why. You may delete your account at any time from the Profile tab. When an account is deleted, the account and the content it posted are removed from our live systems straight away and are never served on the site again from a backup; the Privacy Policy sets out what is kept, for how long, and how to ask for deletion if you can no longer sign in.

8. Our responsibility to you

Birdied is provided free of charge and as it is. We will run it with reasonable care and skill, but we do not promise that it will always be available or free of faults, and the course facts on it may be out of date. We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care, and for anything the law does not let us exclude, such as death or personal injury caused by our negligence, or fraud. We are not responsible for loss that was not foreseeable, for loss caused by something outside our control, or for any business loss.

9. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute about them. If you live in Scotland or Northern Ireland you may also bring a claim in your own courts, and if you live elsewhere you keep any protection the mandatory law of your country gives you.

10. Changes to these terms

We may update these terms as Birdied changes. We will tell you about a significant change through the app or by email before it takes effect, and the date at the top of this page shows when they were last changed. If you keep using the Service after a change takes effect, the changed terms apply; if you do not agree with a change, you can delete your account.
